The People Committee for Solidarity with Sheikh Muayed and his Assistant, as well as the other Yemeni political and civil institutions have followed up the matter of arresting them in Frankfurt, Germany, as he traveled there for treatment purposes, since he is in a very bad health condition. The German security authorities have arrested him upon a request submitted by the American authorities, under the claim that his name is listed among the people wanted by the US. The detention period has been exceeding one year since 10.1.2002.

This act is considered as a clear infringement against the International Law and the relevant regulations protecting the human rights. It is, actually, a piracy act than cannot be overseen.

So far, the European Court for Human Rights has been considering the appeal submitted by Sheikh Al-Muayed through his attorney, Mr. Klaus Günter Neumann. The extradition decision made by the German authorities is contrary with Article 1 (paragraph 5) of the European Convention for Human Right, since it has intentionally overseen any regulations of the European Court, as well as all conventions of human rights.

The attorney of Sheikh Al-Muayad has submitted an appeal to the High Federal Court of Frankfurt considering the extradition decision as illegal and contrary with the relevant international law and the simple rights of the human being protected by the Article 25 of the German Constitution. This article stipulates, “The general rules of the Int. Law are an integrated part of the Federal Law of Germany”. They apply to all individuals legally entering or residing in the German territories.

Further, the American authorities have practiced deception by violating the Yemeni sovereignty, since the Yemeni Constitution prohibits extraditing of any Yemeni citizen to any other country.

Hence, the attorney has requested the Constitutional Court of Germany to settle this case basing on the Article 100/2 of the German Constitution. However, the aforesaid court did not responded to this request.

Yet, The People Committee for Solidarity with Sheikh Muayed and his Assistant would like to seize this opportunity to call the Democracy & Human Rights Conference for an immediate release of Sheikh Al-Muayad and his assistant, and appeal all international human rights organizations, whether governmental or non-governmental, as well as all those concerned in protecting the human rights, to give their solidarity with Sheikh Al-Muayed, who was arrested and currently detained by illegal justifications.
